About MAESTRO MUSIC, Inc.
MAESTRO is a service and system and software that enables members to set up unique personal profiles around their personal online media for an access and networking service operated by MAESTRO Music Inc. and/or wholly-owned subsidiaries ("MAESTRO"), which includes MAESTRO software, content, related documentation, information on the MAESTRO domain, and information made available by users to each other on the Internet through the MAESTRO Software (collectively, the Service). MAESTRO allows you to access, discover, and listen to music (online and off). MAESTRO members can view each other's profiles, listen and discover music, communicate with people on the network, old friends and meet new friends, share photos, post information and comments, and describe their interests. To enrich our members' experience, we request and display personal information to other members and visitors, which allows our users to identify each other and expand their network of friends and interests. MAESTRO utilizes and sometimes shares with certain content providers and partners anonymous data in aggregate form relating to the overall listening choices and habits of our MAESTRO members. MAESTRO members create their profiles, and have the ability to change their profile information at any time. They also have the ability to control how other members and the service communicate with them.
Information Collection and Use by MAESTRO
MAESTRO collects information submitted by its users, such as name, email address, and age, to authenticate users and to send them notifications relating to the MAESTRO service. MAESTRO also collects other personal identification information and preference data, including but not limited to, personal interests, gender, age, education, hobbies, and occupation, etc., and other content such as photos, music metadata, and blogs (web logs) in order to assist users to find and communicate with each other. This additional information is voluntary and can be made available to other members. For privacy protection, the Service allows users' to limit who can view and access personal information.
When users invite new members into their network or send messages through the Service, MAESTRO collects and maintains the information associated with those messages, including email addresses and content on secure servers. As with any social networking service, users should use discretion when disclosing personal information to strangers. Be advised that if users send messages or post material containing personal information, that information may be collected and used by others. In order to provide the best possible Service and fulfill our reporting obligations on webcasting of music, we collect aggregate information about your use of the Service.
MAESTRO also logs non-personally-identifiable information including IP address, general profile information, aggregate user data, and browser type, from users and visitors to the MAESTRO site(s) and mobile applications. This data is used to manage the website, mobile applications, track usage and improve the website services, among other things. This non-personally-identifiable information may be shared with third-parties (including MAESTRO content provider partners) to provide services and advertisements to members. User IP addresses, zip codes, and other geographic location information are recorded for security and monitoring and other benign purposes. MAESTRO collects information concerning software you have downloaded from MAESTRO, products and content purchased, accessed, downloaded and/or streamed through MAESTRO products or services (including, in the case of music products, tracks streamed, purchased or saved in libraries or playlists, or shared with others). MAESTRO uses your personally identifiable information and certain non-personally-identifiable information (such as anonymous User usage data, cookies, IP addresses, browser type, click stream data, etc.) to improve the quality and design of the MAESTRO Sites and to create new features, promotions, functionality, and services by storing, tracking, and analyzing User preferences and trends.
User Profile information including members' pictures and chosen usernames are displayed to users and visitors in order to facilitate interaction in the MAESTRO community. Email addresses are used for the purposes of inviting new friends to join MAESTRO, to add users to members' friends' networks, and to send notifications related to the service. With the exception of inviting friends, adding friends, and notifications, a user's email address is not shared or displayed to people within a user's personal network. Users within a personal network communicate on MAESTRO with each other through the MAESTRO service, without disclosing their email addresses – unless they so chose. To facilitate searching and finding friends and acquaintances on the service, MAESTRO allows users to search for other members using first and last name, and email address. MAESTRO also allows users to connect their MAESTRO account with their Facebook account for the purposes of finding friends on the Service and sharing personal music listening history with user's friends on Facebook, if he/she so chooses. We may also use a user's email address to send updates, a newsletter, or news and updates regarding the Service.
Personal information or media content voluntarily disclosed online (on discussion boards, in messages and chat areas, within your public profile page, etc.) becomes publicly available and can be collected and used by others. Account names (not email addresses) may be displayed to other Users when you upload videos or send messages through the MAESTRO Sites and other Users can contact you through messages and comments. Any media submitted to the MAESTRO Sites may be redistributed through the Internet and other media channels, and may be viewed by the general public.
From time to time, MAESTRO or a partner may sponsor a promotion, sweepstake or contest on MAESTRO. In order to participate, users may be asked to provide personal information including name, email address, home address, or other relevant information to answer questions. We may transfer personal information to ad partners that you have explicitly requested to receive information from. It will be clear at the point of collection who is collecting the personal information and whose privacy statement will apply.
Invitations and Other Communications to Non-members - MAESTRO members can invite friends to join the service by sending invitation emails via our automated invitation system. MAESTRO stores the email addresses that members provide so that the respondents may be added to the referring member's friend's list, and also to send reminders of the invitations. MAESTRO does not sell these email addresses or use them to send any other communication besides invitations and invitation reminders. Recipients of invitations from MAESTRO may contact MAESTRO to request the removal of their information from our database.
MAESTRO members may also store email addresses of people they know in their internal MAESTRO address book and may also choose to send invitations and other communications to those addresses.
MAESTRO uses your personal information to:
• Deliver to you and bill you for MAESTRO products and services, and communicate with you concerning your account and customer service issues. This may include verifying authorization of credit card usage before any purchase of premium content or services (e.g., for the purposes of access to a free trial or to the premium subscription tiers);
• Verify access rights to premium content or other access-restricted services and software, including for the purpose of supporting digital rights management software;
• To operate, maintain, and provide the features and functionality of the MAESTRO Service and Sites;
• Improve our software and services by providing personalized content recommendations, language and location customization, and/or personalized help and instructions;
• Determine if you meet the minimum system requirements to use our products, and provide information concerning compatibility and interoperability to you;
• Track content accesses, downloads and streams for the purpose of paying any necessary royalties and license fees to third-party providers, such as record labels and other copyright holders and content distributors and partners;
• Ask you to participate in surveys about products, services, news and events;
• Offer you product upgrades, content, services and games for you to purchase;
• Provide you with content, services, instructions, and a more personalized experience based on personal information, such as your language preferences, zip/postal code, country locations, and any content or other preferences you provide;
• Auto-update downloaded MAESTRO products and customer service purposes;
• Provide you with news, free newsletters, updates, targeted advertising, promotions, and special offers; and
• Better understand how our products are used, including Web traffic patterns and what types of content are most popular with users of our products and services.
Third Party Cookies
We, or a data provider we have engaged, may place or recognize a unique cookie on your browser to enable you to receive customized ads, content or services. No personally identifiable information is on, or is connected to these cookies. The cookies may reflect de-identified demographic or other data linked to the registration data you have submitted to us, e.g., your email address, in hashed, non-human readable form. MAESTRO's desktop software application resides on computers, gaming devices, set-top boxes, and connected devices. At certain times, such as when a user records broadcast media or adds new media files, MAESTRO creates a thumbprint, an irreversible signature that contains no media content, which is used to dynamically update the user's personalized index of files. Thumbprints do not contain any personally identifiable information such as your name, the subject of the content or the content file itself. MAESTRO software periodically contacts us to check for software updates, and no personally identifiable information is sent in this communication.
Chat Rooms, Journals and WebLogs, Message Boards, Classifieds and Public Forums
Please be aware that whenever you voluntarily post public information to Journals, WebLogs, Message Boards, Classifieds or any other Public Forums that that information can be accessed by the public and can in turn be used by those people to send you unsolicited communications.
Correcting/Updating or Removing Information
MAESTRO users may modify or remove any of their personal information at any time by logging into their account and accessing features such as Edit Profile and Account Info. Users can adjust privacy settings by using the MAESTRO client to limit viewing of certain information to the user, to friends, to friends of friends or make the information available to everyone.
Users may decline to submit personally identifiable information through the MAESTRO sites, in which case MAESTRO may not be able to provide certain services to the user, and also could deny accepting the applicant. You may update or correct your personal profile information and email preferences at any time by viewing your account profile on www.maestro.fm.
To protect the user's privacy and security, MAESTRO takes reasonable steps such as requesting a unique password to verify the user's identity before granting profile access or making corrections. The user is responsible for maintaining the secrecy of their unique password and account information at all times.
Users can terminate their account that will remove profile and other personal information. Contact MAESTRO to terminate your account or to ask other questions regarding personal information.
Other Users Information
If members invite another person to join MAESTRO, a request for that person's name and email address will be made. This information is used to contact and, if necessary, remind the individual that he/she has been invited to join MAESTRO. All invitees are provided with the option not to receive further invitations from MAESTRO. This information may be disclosed if required in order to comply with any legal process.
Members who wish to opt out of receiving updates or notifications, including the MAESTRO newsletter, may choose not to by selecting the respective box(es) on the ‘Email Settings' pane under Settings in their user profiles.
Ads appearing on this Web site may be delivered to users by MAESTRO or one of our advertising partners. Our advertising partners may place cookies on your computer. These cookies allow the ad server to recognize your computer each time they send you an online advertisement. In this way, ad servers may compile information about where you, or others who are using your computer, saw their advertisements and determine which ads are clicked on. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you.
MAESTRO member accounts are secured by member-created passwords. MAESTRO takes precautions to insure that member account information is kept private. We use commercially reasonable measures to protect member information that is stored within our database. For MAESTRO services, we utilize Secure Sockets Layering, an industry-standard protocol for certain of your transmissions to us, in order to encrypt the personal information that you send to us through the registration process or to make updates to your payment information. MAESTRO cannot guarantee the security of member account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of member information at any time. If a MAESTRO user forgets their password, you will be prompted to go on the Site, insert your email address, and follow the instructions to create a new password. No plain text passwords will ever be passed through e-mail. MAESTRO recommends you do not disclose your password to anyone. If users suspect someone may have obtained access to your password, please change it immediately by signing in to your account at www.maestro.fm to manage your "MAESTRO Account Settings".
Information Provided to MAESTRO Customer Service
MAESTRO services may offer support and technical assistance via e-mail or telephone ("Customer Service"). When communicating with Customer Service, users do so with the understanding that a Customer Service team member may view and make changes to a user's personal information in order to provide the assistance requested and MAESTRO Customer Service may reply to you via email, phone or text message.
MAESTRO is committed to protecting the privacy of young children. For this reason, MAESTRO does not knowingly collect or maintain personally identifiable information or non-personally-identifiable information on the MAESTRO Sites from children under the age of 13 without permission. MAESTRO encourages parents and guardians to take an active role in their children's online activities and interests. If MAESTRO becomes aware that personally identifiable information of such a person has been collected on the MAESTRO Sites without verified parental consent, then we will take the appropriate steps to delete said information.

IF YOU DON'T AGREE TO THESE TERMS, DO NOT CLICK THE “ACCEPT” BUTTON AND DO NOT USE THE SOFTWARE OR THE SERVICE.
THIS IS YOUR CHOICE. MAESTRO hereby grants to you a limited, non-exclusive license to use our Applications solely for personal, noncommercial use, subject to this Agreement, including the following terms: You may not: (i) frame or link to an Application except as expressly permitted in writing by MAESTRO; (ii) permit other individuals to use the Application; (iii) modify, translate, reverse engineer, decompile, disassemble (except to the extent that this restriction is expressly prohibited by law), tamper with, or create derivative works based upon the Application, including the Content or any portion thereof (including without limitation any watermarks, security components and digital rights management); (iv) copy the Application or any portion thereof; (v) sell, rent, lease, transfer, distribute, broadcast, display or otherwise assign any rights to the Application to any third party; (vi) remove any proprietary notices or labels on the Application; (vii) use the Application in conjunction with any device or service designed to circumvent technological measures employed to control access to, or the rights in, a content file or other work protected by the copyright laws of any jurisdiction; (viii) use the Application for any commercial or illegal purpose; (ix) use the Application for anything other than your personal, non-commercial purposes, including without limitation the excessive and/or repeated playing of content (for the apparent purpose increasing royalties paid or ratings as applied to such content); (x) use the Application to invade the privacy of, or obtain personal information about, any Application account holder or user, or to obtain a list of Application account holders or users; (xi) copy, modify, erase or damage any information contained on computer servers used or controlled by MAESTRO or any third party used in connection with the Application or the services provided through the Application; (xii) use the Application to violate any legal right of any third party, including any publicity or privacy right, copyright or other intellectual property right, or to take any action that is harassing, libelous, defamatory, abusive, tortious, threatening, harmful or otherwise objectionable; or use any data mining, robots, or similar data gathering and or extraction tools in connection with the Application; (xiii) use the Application to post or transmit any unsolicited advertising or promotional materials; (xiv) access or use any password-protected, secure or non-public areas of the Application except as specifically authorized in writing by MAESTRO (unauthorized individuals attempting to access these areas of the Application may be subject to prosecution); (xv) impersonate or misrepresent your affiliation with any person or entity; (xvi) use any automated means to access or use the Application (including scripts, "bots" or similar software); or (xvii) modify, translate, reverse engineer, decompile, reproduce, disassemble, or otherwise gain access to or attempt to gain access to any private key or dev key (as that term is generally understood within the industry) associated with the Application, the Content or the Services, or to use or attempt to use any private key or dev key in a manner in violation of this Agreement.
